The Patna High court directed Re-evaluation of answer sheets of PG MD/MS session (2019- 2022) of 17 Petitioners against Aryabhatta knowledge University

Introduction

That on 7/4/25 Hon'ble Patna High Court by the bench of Hon'ble Justice Anjani Sharan directed Aryabhatta Knowledge University to recheck/re-evaluate the answersheet of Petitioner appeared in post graduation for MD/MS (3year course) final year (2019-2022 session).

Learned Advocate Shubhangi Pandey appearing for petitioner submits that the petitioner's case is squarly covered by the Judgement passed by a co-ordinated bench of this court in Shahil raj Vs. Aryabhatta Knowledge University & Ors in CWJC No. 5217 of 2018 dated 5/4/2018. Respondent University Submits that regarding the aforesaid subject matter a scrutiny committee was constituted & scrutiny has been done.

That the present writ petition allowed with a direction to the petitioners to deposit Rs. 50,000/- per student within a period of one week and the Vice-Chancellor of the Aryabhatta Knowledge University, Patna is also directed to consider the case of the petitioners for sending the answer-sheet, in question, for re-evaluation to an expert of petitioners' subject area, who should be preferably other than the person who had earlier evaluated the same within a period of four weeks thereafter.

The decision follows claims that the initial evaluation was flawed and unfair. The Court also clarified that if the revaluation results in a higher score, the revised marks will be final and binding. This order, however, shall not be considered a precedent for future cases.
